This study aims to answer doubts about the chronology of the emergence of soko assets in the tradition of inheriting property in the Kampar community, the practice of implementing the distribution of soko assets which is equated with the concept of dzurri waqf, and a review of maqashid shari'ah on this distribution pattern. The method used is a qualitative research method where the method in this study is the main source of data obtained by conducting direct research on the tradition of the distribution of soko property by observing the situation in the field and then describing and analyzing so that it can answer the problems that have been formulated in the problem formulation. This study uses data collection methods with observation, interviews, and documentation studies. After the data is obtained based on the subject matter, a qualitative data analysis method with a descriptive approach is used. The results of this study show that the soko property in the Kampar people's customs emerged based on the culture brought by the Kampar limo koto custom which originated from the Minangkabau country, where the majority of family relationships are based on matrilineal. The positive impact of the distribution of soko property is to maintain the preservation of family property and protect the descendants of women. Meanwhile, the negative impact is that there are several families who deliberately sell the property to outsiders by violating customary advice, and are not serious in managing the property so that it is far from productive value. Then the solution if there is a conflict of division and management, gradual mediation such as mediation between families, mediation between ninik mamak, and the last step through the positive legal process in Indonesia. The review of maqashid shari'ah on soko property is to meet the needs of dharuriyyat, hajjiyyat, and tahsiniyyat.
Ferry IchsanAnwari Kasmidin Kasmidin Maghfirah Maghfirah Copyright (c) 2025 Tasyri' : Jurnal Muamalah dan Ekonomi Syariah 2025-04-01 2025-04-01 7 1 30 48 10.55656/tjmes.v7i1.352 Penerapan Denda Pada Jual Beli Taqsith Perspektif Hukum Islam https://ojs.staisdharma.ac.id/index.php/tjmes/article/view/324
Buying and selling on credit is easier than using cash because you can get what you need, when you can't buy in cash, as is the case with the people in Ciluluk Village who do this common thing. With this convenience, sometimes the buyer makes a mistake, namely being late in paying the installments, so the seller imposes a fine on the buyer, but the fine is not notified to the buyer at the time of the contract. This research aims to determine the implementation of credit buying and selling (taqsith) with a fine system at the Ibu Novi Shop, Ciluluk Village, Cikancung District and to find out the perspective of Islamic law on the application of credit buying and selling fines (taqsith) at the Mrs Novi Shop, Ciluluk Village, Cikancung District. This research is a type of empirical normative research with a descriptive qualitative approach, with data collection using observation, interviews and documentation. The results of this research are that in practice, the sale and purchase of credit (taqsith) is considered to be damaged (facade) in the contract, because there are fines that are not disclosed at the time of the contract. According to Islamic law, the law of buying and selling credit (taqsith) at Mrs. Novi's shop in Ciluluk Village is invalid because it violates the rules of Islamic law, where the fine is applied suddenly and the funds from the fine are not intended for social funds.
Lina SitiHalimah Ginan Wibawa Copyright (c) 2025 Tasyri' : Jurnal Muamalah dan Ekonomi Syariah 2025-04-01 2025-04-01 7 1 49 61 10.55656/tjmes.v7i1.324 Meningkatkan Keadilan Sosial Ekonomi melalui Implementasi Akhlaq dalam Hukum Islam https://ojs.staisdharma.ac.id/index.php/tjmes/article/view/219
This research aims to explore the potential of enhancing socioeconomic justice through the implementation of morality within Islamic law.
